For a Foundation that does not carry out all of its activities from an office, maintaining permanent workspace may not always be a priority. However, the need for a clear address still exists, particularly for organizational administration and communication with external parties. This is what makes a virtual office an attractive option. The question is whether a virtual office address can be used by a Foundation and what needs to be checked first.

Under Indonesian law, a Foundation is a legal entity operating in the social, religious, and humanitarian fields. Law Number 16 of 2001 concerning Foundations, as amended by Law Number 28 of 2004, provides the main legal framework when discussing the Foundation's domicile and administration.

A Foundation's place of domicile is not simply an address used for communication. In AHU administration, the place of domicile together with the full address forms part of the Foundation's establishment documentation. AHU specifically lists a statement of domicile together with the Foundation's full address among the required establishment documents.

Therefore, when a Foundation considers a virtual office, the first priority should not simply be finding an address that looks professional. The key is to make sure that the address can be used and properly supported for the Foundation's administrative needs.


A Virtual Office Does Not Mean the Foundation Has a Full Physical Office

A virtual office generally provides an address and selected office services without giving the Foundation permanent workspace like a conventional office. Services may include mail handling, reception, meeting rooms, or workspace access, depending on the provider and selected package.

This model can be relevant for Foundations whose administrative activities operate flexibly. Board members or team members can work from their respective locations while the organization maintains a clear address for specific needs.

However, a virtual office does not automatically replace the physical location where a Foundation's activities take place. If a Foundation operates activities that require specific physical facilities, such as a school, clinic, social service facility, warehouse, or other premises, those location requirements still need to be met under the applicable rules.


What Needs to Be Checked with AHU Is More Than the Address

Because a Foundation is a legal entity, the use of an address needs to be considered within the Foundation's overall administration. The Articles of Association, place of domicile, full address, and organizational data should remain consistent.

AHU provides dedicated services for Foundations and handles establishment as well as changes to Foundation data through its legal administration system.

This means that before using Virtual Office Jakarta for a Foundation, the question should not simply be whether the provider offers an address. The Foundation should also check how that address can be used in its documents and whether the provider's service arrangement supports the organization's administrative needs.


What About OSS and a Foundation's Business Activities?

This needs to be distinguished from the Foundation's legal domicile. A Foundation is not established to distribute profits to its founders or management. However, AHU explains that a Foundation may establish business entities in accordance with its vision and mission.

If there are business activities that fall under the business licensing framework, the discussion may also involve OSS and the risk-based business licensing requirements. OSS currently uses a risk-based business licensing system and describes the NIB as the official identity required to start or operate a business in Indonesia.

For this reason, the Foundation's place of domicile should not automatically be treated as the same thing as the address or location required for a particular business activity. The two may serve different purposes and be subject to different requirements.


The Virtual Office Location Still Needs to Make Sense

If a Foundation needs an address in Jakarta, Virtual Office Jakarta will probably the starting scope for the search. The choice can then be narrowed down to Virtual Office Central Jakarta or Virtual Office South Jakarta, depending on the organization's needs and the people who regularly interact with the Foundation.

For a more specific location, Virtual Office Thamrin, Virtual Office SCBD, or Virtual Office TB Simatupang may also be considered. However, the location should not be selected simply because it sounds prestigious. Accessibility for management, partners, donors, administrative activities, and meetings is much more relevant.


So, Can a Foundation Use a Virtual Office?

It can be an option, but it should not be treated as an automatic solution for every Foundation address and operational requirement. What needs to be confirmed is whether the address is consistent with the Foundation's place of domicile, whether the administrative data remains consistent, whether the provider's services are suitable, and whether the Foundation has any additional requirements arising from its activities.

For a Foundation that does not need a physical office every day, a Virtual Office becomes practical solution. However, when the Foundation's activities require specific facilities or physical premises, a virtual office does not automatically replace those requirements.

The better question is therefore not simply “Can a Foundation use a virtual office?”, but “Does the selected virtual office address and service fit the Foundation's place of domicile and activities?” This is where checking AHU records, Foundation documents, and—any certain activity—OSS requirements becomes important.
